Terms of Use
Last updated: October 25, 2026
Trailmarker (trailmarker.app) is a free travel-mapping site ("Trailmarker", "we", "us"). By creating an account or using Trailmarker, you agree to these Terms. Please also read our Privacy Notice.
1. Trailmarker is free
Trailmarker is an independent passion project. You don't pay to use it, and we don't run ads on it. To keep it free, we promote Trailmarker using the content travelers publish and share (section 4) and with the branding on share cards (section 6).
2. Your account
- You must be at least 13 years old to create an account.
- Give a real email address and keep your password safe. You're responsible for what happens on your account.
- Your username, display name and profile photo can be shown publicly next to anything you publish.
- Don't pretend to be someone else.
3. Your content belongs to you
You own the photos, stories, trips, pins, comments and everything else you add to Trailmarker ("your content"). These Terms don't transfer ownership of anything to us.
So that the site works, you allow us to store, copy, resize, convert and display your content: privately to you, and publicly for anything you publish.
4. We can use what you publish to promote Trailmarker
By agreeing to these Terms, you give Trailmarker permission to use your published content to display and promote Trailmarker, on Trailmarker and outside it, including on our social media accounts, in advertising, in emails and in other marketing.
"Published content" means:
- travel stories once they're approved and published, including their photos;
- trips once they're live, including their cover and stop photos;
- your public travel page and approved comments; and
- share cards and postcards you save or share, including the photos in them.
When we use it:
- You still own it. This permission is non-exclusive: you can keep using your content however you like.
- We'll credit you by your display name or username. Where an ad format has no room for a credit, we'll put it alongside, for example in the post's caption.
- We may resize, crop and format your content, add Trailmarker branding or text, and combine it with other content, without changing what it says.
- The permission is worldwide and free of charge, and lets the platforms we post on (for example Instagram or TikTok) host and show it as part of our posts. You aren't paid for content used this way.
- Content you keep private is never used. That includes pins, notes, private photos, drafts, and anything waiting for review.
- You can ask us to stop. Email nikolaswood92@gmail.com with a link to the piece, and we won't use it in new promotion. Things we've already published (a post that's live, an ad that's already printed) may stay where they are.
- Being featured doesn't mean you endorse Trailmarker or that we endorse you.
5. Only post what you have the right to
By adding content to Trailmarker, you confirm that:
- you took the photos and wrote the content yourself, or you have permission to share them;
- any identifiable people in your photos are happy to appear in them, including being shown in Trailmarker's promotion under section 4, and you have a parent's or guardian's permission for any children shown; and
- your content doesn't break these Terms or the law.
6. Trailmarker branding on share cards
Share cards, story cards, trip cards and postcards made on Trailmarker include the Trailmarker logo and www.trailmarker.app. That branding helps keep Trailmarker free, so please don't crop or edit it out of cards you share. Your own original photos and writing are always yours to share without it. Branding-free cards aren't currently offered. If you're interested, get in touch.
7. Rules
Don't use Trailmarker to:
- post anything illegal, hateful, harassing, threatening or sexually explicit, or anything that endangers children;
- post anyone's private information (such as a home address or where they are right now) without permission;
- infringe anyone's copyright, trademark or privacy;
- send spam, including inviting people who don't want to hear from us;
- scrape or copy the site with automated tools, break its security, or overload it.
8. Review and removal
We review stories, trips and comments before they're published, and may lightly edit them for formatting or fix their place and date details. We can decline, unpublish or remove any content, and suspend or close accounts that break these Terms or put others at risk. Where it makes sense, we'll tell you why.
9. Reporting content
If something on Trailmarker uses your work without permission, or breaks these Terms, email nikolaswood92@gmail.com with a link to it, an explanation, and your contact details. If you're reporting your own copyrighted work, also confirm that you're the owner (or allowed to act for them) and that the information you've given is accurate. We'll look into it and may remove the content. We close the accounts of people who repeatedly post others' work.
10. Leaving Trailmarker
You can stop using Trailmarker at any time. To delete your account, email nikolaswood92@gmail.com from your account's email address. Your published stories and live trips may stay on Trailmarker without your name unless you ask us to remove them too. Content already used in promotion under section 4 may stay where it was posted.
11. Trailmarker isn't a backup, and comes with no guarantees
Trailmarker is a tool for mapping and sharing your travels. It isn't a photo storage or backup service. Always keep your own copies of your photos and writing somewhere else.
- Photos are resized and compressed when you upload them, so what Trailmarker stores isn't your original, full-quality file.
- Your photos and content could be lost, deleted or damaged, for example through a technical problem, a mistake, or Trailmarker changing or shutting down.
- Trailmarker is provided free, "as is" and "as available". It may change, have downtime or stop at any time.
- Map, place and trip information comes partly from other travelers and outside sources and may be wrong. Check it before you rely on it.
12. Limits on our liability
To the extent the law allows, Trailmarker isn't liable for lost, deleted or damaged photos or other content, for any indirect or unforeseeable loss, for content posted by other people, or for problems caused by outside services. Because Trailmarker is free, our total liability to you is limited to US$10. Nothing in these Terms limits liability that can't legally be limited, or takes away rights you have under consumer law.
13. If your content causes a claim
To the extent the law allows, if someone makes a claim against Trailmarker because of content you posted or because you broke these Terms (for example, a photographer whose photo you uploaded without permission), you agree to cover the reasonable costs that claim causes us.
14. Changes
We may change Trailmarker and update these Terms. If we make an important change, we'll ask you to agree to the new version the next time you sign in. If you don't agree, you can stop using Trailmarker and ask us to delete your account.
15. Law and contact
These Terms are governed by the laws of the State of Missouri, USA. If something goes wrong, please contact us first at nikolaswood92@gmail.com and we'll try to sort it out.
